Terms of Service
These Terms of Service ("Terms") govern your use of Linky, a URL shortening and analytics service (the "Service"). By creating an account, using the Service, or accessing any part of the site, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
Linky grants you a limited, non-exclusive, non-transferable right to use the Service subject to these Terms. You agree not to use the Service for any illegal purpose or in a manner that would violate applicable laws or third-party rights.
2. Accounts and registration
To access certain features you must create an account. You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under your account. You must provide accurate information and keep it up to date.
3. Payments and subscriptions
Paid features are billed through our payment processor (for example Stripe). By purchasing a paid plan you authorize us to charge your chosen payment method and agree to the plan’s pricing, billing, and refund terms. We may suspend or terminate paid features for failed payments or suspected fraud.
4. Content and intellectual property
You retain ownership of the content you create using the Service (for example, original URLs, link descriptions). By using the Service you grant Linky a worldwide, royalty-free license to host, store, and display that content as necessary to provide the Service.
5. Prohibited uses
You agree not to use Linky to create links that: (a) contain malware or phishing; (b) infringe intellectual property or privacy rights; (c) facilitate illegal activity; or (d) abuse the Service (spam, excessive automated requests, scraping, etc.). Linky reserves the right to remove content or suspend accounts for violations.
6. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKY AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNTS YOU PAID TO LINKY IN THE PRIOR TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
8. Termination
We may suspend or terminate your access to the Service at any time for violations of these Terms or for reasons related to the security, maintenance, or health of the Service. Upon termination, your right to use the Service is revoked, and any unpaid fees remain payable.
9. Governing law
These Terms are governed by the laws of the jurisdiction in which the Service operator is incorporated, without regard to conflict-of-law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by law.
10. Changes to the Terms
We may update these Terms from time to time. When we make material changes, we will provide notice via the Service or by other means. Continued use after changes indicates acceptance of the new terms.
